Texas S B 8 is still in effect. "The Texas Heartbeat Act has been subjected to numerous lawsuits in state and federal court, but the statute has thus far withstood each of these court challenges and
remains in effect." - Wikipedia (article last updated in June 2022)
From a different article...March 2022
here"Molly Duane, an attorney with the Center for Reproductive Rights, which is challenging the law, says providers also are "extremely and understandably fearful" of providing abortions even in medical emergencies because of the law's design, which allows individuals to enforce it through civil suits.
"A physician who made that determination in the moment would be doing so knowing that if someone second-guessed their judgment,
[anyone] could file a lawsuit saying that you violated SB 8," she says.
and another article, April 2022
from the Guardian says, "SB 8 is not directly enforced by government officials, but includes an unprecedented private enforcement provision that allows any individual – including anti-abortion vigilantes with no connection to the patient – to sue abortion providers or anyone who “aids or abet” care. Those who bring successful suits can win at least $10,000 in damages. The scheme – meant to evade judicial review –
has thus far allowed the law to remain in effect, despite previous legal challenges."A judge named Pitman struck the law down on Oct 6 2021
. The Fifth Circuit, then blocked Judge Pitman’s order a few days later and left S.B. 8 in effect pending a December hearing. The Supreme Court's December ...."decision did not make any statement on the constitutionality of SB8, allowing the law to remain in enforcement"
So, Texas S B 8 is still in effect. Including the snitch lawsuit methodology. If it had been struck down in any real or meaningful way there would have been headlines everywhere. But, alas, crickets.
