Shocking!: Another SCOTUS Victory For Trump!

I've decided it's a myth that you have more free time when you retire. I, too, have never been busier! Something always needs to be done, or there are family obligations to attend to, or doctors to see, and all of the other sundry items that have to be taken care of to keep a household and its occupants up to minimal standards of cleanliness and care.

My sincere condolences on your loss. We still have my mother, but at 86, she's declining before our eyes. She still lives alone, but that prospect is becoming more tenuous all the time. We just got back from spending a week with her to help her recover from a fall. Thankfully, no broken bones, but she's an ornery 86-year-old who vows never to leave her home, yet refuses to modify her behavior, and continues taking unnecessary risks. So, the likely outcome is that an eventual tragedy will force the issue. Until then, all we can do is be there to pick up the pieces. I tell my kids not to worry, that I won't fight when and if my day comes, but I sometimes wonder if it will be that easy. In any case, I'm glad you survived your ordeal and found something good about it, even though I'm sure it had its share of unpleasantness.

It's just another example of Trump and his band of merry men pulling every lever they can to achieve their agenda. The emergency docket, or shadow docket, was never intended to be used the way Trump's administration is using it. A significant portion of what they are submitting to the shadow docket does not rise to the level of an emergency. Just like his fake emergencies, they have used to justify tariffs, for example.

On the other hand many executive actions in the fields of immigration, agency operation, agency staffing and the like are probably or possibly constitutional, even though these actions have naturally pissed off those on the left.  In addition to litigating these policies on the merits, the Democrats have sought out nationwide injunctions from friendly jurisdictions.  Setting aside those injunctions pending briefing and argument is a reasonable use of the emergency docket, even though Rod and his sources squeal like it is the end of democracy.   In every one of these cases, the emergency order is designed to best preserve the status quo until the full hearing on the merits occurs.   The case that started this thread is a good example.  The Court is using its emergency docket to decide that the Fed Governor could keep her job until a full hearing occurs on Trump’s authority to fire her.  The Court is preserving the status quo to the best of its ability.   There is no guarantee that the Fed governor keeps her job after evidentiary hearings in the lower courts and possibly briefing and oral argument at the Supreme Court.

Bottom line:  Yes Trump is pushing the boundaries hard and probably overstepping his authority in many instances. At the same time, the Democrat Resistance is seeking, and in many cases, getting injunctions of executive action at the trial court level, even when the reviled executive action is probably constitutional. This combination of overreach and excessive resistance push-back is causing the huge increase in Emergency actions which must be heard by the Supreme Court. Those who write articles from the left acting like this is the end of democracy simply don’t understand these rulings, or perhaps they can’t resist grossly politicizing the scope of the rulings being issued at the emergency docket level.   People sure eat up the “shadow docket” bs.   Ohh, how sinister!

By the way, the left is going to lose a lot of these cases when the hearings on the merits occur. The Supreme Court has a 6-3 conservative majority. This is the Democrat’s fault. If they wanted the opportunity to appoint Supreme Court justices, they needed to win a couple of exceptionally winnable elections.

The current makeup of the court isn't just about winning elections, although that was a big part of it. It doesn't help that McConnell stalled an appointment for over a year that Obama should have received, while McConnell then rushed through some of Trump's appointees. I get it; it's hardball politics at its finest, and my only point is that it's not all about winning elections. Some of the liberal justices who are no longer with us should have been more strategic about their retirement. In contrast, the conservative justices have happily retired to ensure they get to choose which party replaces them. Basically, the Democratic Party focuses way too much on process and optics rather than results. I believe it's one of the chief complaints its supporters have right now. I, for one, want the Democrats to be aggressive and push back more. Specifically, it would be great if they would stop the push by Republicans to weaken the ACA to the point of failure. So many people are going to be harmed needlessly over their irrational crusade against the ACA. Haha. Sorry to veer off-topic; I know many people who will have to go uninsured or pay exorbitant premiums if Congress doesn't extend the enhanced premium tax credits.

The Trump administration later posed the same question and it received an immediate response and review by the docket. So, it appears that the politically conservative element of the court determines what is heard and what is not by their biases and not necessarily by the process that you've described.

Additionally, as noted by a lower court judge in that CNN video, the court is not providing the guidance that it should to the lower courts in its lack of explanations for their shadow docket rulings and, in essence, alternately either refers to them as de facto precedents and/or determinations that can't somehow be provided in writing because a final determination hasn't been made by SCOTUS. Since there's no clarification by SCOTUS on this self-created problem, it appears to be a major contradictory issue on their part, or perhaps a major error of omission due to apparent judicial incompetence.

To simply say, on your part, that's it's the fault of democrats not winning more elections to influence the makeup of the court seems unreasonable and untenable in light of the above.

The emergency docket has a pretty low standard of entry. I think a single justice can refer an application to the full court? This low barrier to entry likely explains why many of Trump's requests are referred. Additionally, the referring justice is assigned to the same circuit as the application originates, allowing the applicant to "circuit shop" if they believe they will receive an injunction from a lower court.

The orders issued on the emergency docket have rarely been detailed orders for all of history.   Also, they are not typically precedent.  Usually the Court grants or denies a stay of a lower court ruling, an injunction for example, while the litigation proceeds.   Did you guys look at those tables, and click on the links?   Did you see all the referrals back for further proceedings?

Here is an interesting aside.  Did you notice all the death penalty cases on the emergency docket?  I did not look at them all, but it appears that these are routinely denied by the Roberts Court.  For better or worse it was not always that way.   This is a good example of the Court’s philosophy trending from left to right based upon the makeup of the Court.

Rod, I know that I’ll never convince you, but you are simply dead wrong when you find incompetence or malfeasance in each of the  Court’s ”disappointing” rulings, when viewed from your liberal perspective.  Any pundit who writes any article whatsoever equating a conservative Court with “wrong” or “incompetent” is just a political hack and probably knows they are lying.   It is not right v. wrong thing, it is conservative judicial philosophy v liberal judicial philosophy thing.   The death penalty cases show this.  Roe showed this.  Smart people like RBG knew this.   Guest editorialist who used to be in the DOJ, or who used to be judges know this too.  You won’t catch them saying it on CNN though.

I think one of the things the CNN article pointed out, though, was that Kavanaugh did say the emergency docket orders "command respect," and chastised lower courts for not following them. That certainly sounds like precedent by another name. On the other hand, lower court judges are frustrated by the Supreme Court's lack of clear guidance on emergency rulings. So, clearly, there is a gap here that feels like it is the responsibility of the SCOTUS to fill, and that is, if they want their emergency order to be followed, then their wishes need to be clear and transparent, regardless of whether they are just denying or granting a stay.

Cloudflare hosts Astromart; nothing unusual about that, since Cloudflare hosts about half the internet.

On October 3rd, they were having an issue they call "1022 errors," which is a Cloudflare-specific error code from what I can tell. It seems to mean that Cloudflare could not find the host or domain you are looking for; i.e., astromart.com

Amazon Web Services (AWS), Google Cloud Platform (GCP), and Cloudflare power a significant portion of the internet. AWS and GCP provide the computers, storage, and tools businesses need to develop and run websites and apps. In layman's terms, AWS and GCP are the construction companies that allow you to build an amusement park for people to enjoy.

Cloudflare helps users find websites quickly, delivers content through its global network, and protects sites from cyberattacks. Think of Cloudflare as the security and traffic control company that works at the entrance to your park.

They all work together to ensure your park functions as expected, and that people can get in and out efficiently and safely; however, sometimes things go awry.

As far as I can tell, Astromart is relatively old technology, mainly consisting of static pages with some client-side JavaScript, but little to no server-side scripting. Therefore, it can be hosted entirely by Cloudflare, but it's hard to tell if that's exactly what's going on, because one of the purposes of Cloudflare is to hide your host so it can't be attacked.

It was interesting work, and I did enjoy it for the most part, but I had to retire early to take care of my wife, who has early-onset Alzheimer's. If not, I would have gladly worked until age 65 to amass a little more wealth and avoid the nightmare of finding and affording healthcare before age 65 without getting it through my private employer. My job enacted a return-to-office policy that was impossible for me to honor, and at about the same time, they offered a generous voluntary severance plan. I requested an exception to continue working from home, but the VSP offer would expire before they could determine if the exception would be granted. So, I took the VSP, and haven't regretted it, other than the whole healthcare issue. I wonder how much of that will be weaponized and used against me, at some later date? Haha.

COLORADO: K-Runs & Gas Prices

PPS: Don't get me started on Ca gas prices and all that goes with it...

Anyone who can run these ultramarathons is impressive, even without having to stop for Taco Bell along the way. The longest my wife and I have ever done is the Dallas half-marathon, but those days are long behind us now.

Sorry to hear about the situation with your wife and I understand the health insurance issue can be difficult so I hope it works out for both of you.

I got my wife on Medicare, so she's all good. I have 26 months till I can get on it, though! In the meantime, I have to do something else, and, aside from finding another job, which is not possible, my only option at my age is to enroll in ACA. You can't even do "catastrophic" policies anymore at my age. In Texas, and I'm sure it's similar elsewhere, you must be 30 years of age or younger to qualify for a catastrophic policy. Exceptions can be made, but you have to be destitute to qualify, which is not my case, and I wouldn't want it to be either. From what I can tell, the system is designed to push everyone who cannot obtain insurance through their private employer and who is not eligible for Medicare onto the ACA. It makes sense because you want everyone to be in the risk pool, but at the same time, the ACA is not affordable for way too many people. The enhanced premium tax credits for the ACA helped significantly with affordability, but if they don't extend those, a large number of people will lose health insurance because they can't afford it. Estimates indicate that 5 million people will lose coverage entirely, and 8 million will have to pay the full premium cost, which is at least $1,000/month for a single person. And that's just for the privilege of having the insurance. If you want to access healthcare, you will be paying significantly more out of pocket because deductibles range from $10,000/year and up. I can afford the premium, and I'll have to pay it, whatever it turns out to be, but this is what they mean when they say our healthcare system is seriously broken and dysfunctional when it comes to providing affordable healthcare. I know several people who intend to go uninsured if the enhanced premium tax credits are not extended into 2026, and even some individuals who are currently uninsured because they can't afford it.
